US indictment of foreign company is unlawful, Dotcom’s lawyers claim

Kim Dotcom’s US lawyers have filed an application with the US District Court of Eastern Virginia, seeking a dismissal of a copyright infringement indictment against his company, Megaupload.

Under a US grand jury indictment filed on January 5, Dotcom, Finn Batato, Mathias Ortmann, and Bram van der Kolk, two other Megaupload employees and two related companies were charged with racketeering, copyright infringement and money laundering.

A second, superseding indictment filed in the US on February 16, added additional charges of copyright infringement and new charges of wire fraud against the defendants.

Dotcom and three other Megaupload defendants, who are currently on bail in New Zealand pending extradition proceedings, have denied any wrongdoing.

In a legal motion filed yesterday, lawyer Ira Rothken argued that to date, the US government “has not served a summons on any officer or agent of Megaupload.”

Furthermore, Rothken argues, it would not be able to serve a summons against the company, even if Dotcom or other Megaupload defendants were extradited to the US.

“Megaupload does not have an office in the United States, nor has it had one previously. Service of a criminal summons on Megaupload is therefore impossible, which forecloses the Government from prosecuting Megaupload.”

In a separate filing, Dotcom lawyers are also seeking the release of some of the $US67 million worth of assets, which were seized by the US government in January, to enable the Megaupload defendants to mount a "full and fair” defence.

According to reports, a spokesman for US prosecutors has declined to comment on the court filings, saying the US government will respond in court at a later date.

Really? NZ must stand up against the out of control doj in the USA. USA needs to continue the spread of the revolution in the USA by voting into power people like Ron Paul. Unfortunately until the USA upholds the US Constitution and repeals all illegal laws that are unconstitutional and funded by corporations, the USA and all other sovereign countries are doomed to collapse. NZ must throw this case out to protect the people of NZ. Please stand up! USA is slowly waking up from the apathy and realizing freedom and Constitutional rights and law are in danger.. from the few traitors that have sworn to uphold the US Constitution and are a threat to the US.
The military, to civilian and even the law enforcement are starting to wake up and demand to be free. The USA has no business doing what has been done to megaupload and kim dotcom. The US freedoms are being threatened and NZ is also please stand up for your people. We can do this peacefully. Everyone needs to speak up. Hope and wish you well NZ.

boycott the US It is not just the perversion of the justin system by vested interests, such as in the Dotcom case, but blatant war crimes and crimes against humanity that initiated my boycott of all things american.
That the 'leaders' and public servants of nz do not boycott this rogue state shows that nothing has changed since the vietnam war and the days of appartheid, nz is still mismanaged by colonial thieve liars and cheats it is clear, especially when signing resource deals with the war criminals of anadarko (look up their board of directors) while passing legislation to prevent sharing any of that wealth with the indigenous peoples ( the stupid nzers not of maori extraction don't expect any benefits as usual, except may be a chance to work for the rip off merchants...
